Non-photographic instruments and apparatus for scientific, nautical, aeronautical, surveying, measuring and indicating purposes; photographic apparatus and instruments, all for cartographic, land survey, aeronautical or nautical purposes, and for photographing air currents and cathode ray oscillograms; electrical apparatus and instruments included in Class 9; wireless and television apparatus; sound transmitting, sound recording and sound reproducing apparatus; optical apparatus and instruments; cinematographic cameras and projection apparatus, all for use in the motion picture industry, electric arc welding apparatus and electric welding electrodes, and parts and fittings included in Class 9 for all the aforesaid goods, but not including flash lamps for photographic purposes or photographic dark-room lamps. this registration is subject to the terms of an agreement dated the 24th March 1958, made between Svenska Aktiebolaget Gasaccumulator (called SAG) of the one part and Aga Heat Limited (called AH) of the other part wherby SAG will not without the prior approval of AH in writing, inter alia ()1) cancel or abandon the mark ()2) alter the specification of goods (3) consent to third parties using the mark or closely resembling trade marks or (4) save in the case of a breach of clause 12 of the agreement, cancel the entry of AH as a registered user of the mark, Further, AH, as registered user of the mark, has the right to institute proceedings for infringement in its own name without the prior approval of SAG and has the right to enforce the said agreement against assigns of SAG.
