Sunglasses.++Under Section 34 ()1) (e) of the Trade Marks Act, 1938, as a result of TM24 application received on 17th June 1987."This registration is subject to the terms of an agreement dated 18th February 1987, made between Foster Grant Corporation (called FGC) of the one part and the Bank of New York Commercial Corporation (called BNYCC) of the other part, whereby FGC will not without the prior approval of BNYCC in writing, ()1) assign the Mark or registration, ()2) abandon the Mark or cancel or abandon the registration, ()3) alter the specification of goods of the registration, or ()4) consent to the use of the Mark or closely resembling Trade Marks by third parties other than the presently entered registered user. Further BNYCC has the right to enforce the said agreement against successors to and assigns of FGC".
