Heat-insulating materials, and articles included in Class 17 made therefrom. The following memorandom is entered in the Register: This registration is subject to the terms of an Agreement dated the 22nd May, 1962, made between Thermos Limited (called Thermos) of one part and Hodgson and Hodgson Limited (called Hodgson) of the other part, whereby Hodgson will not without the prior approval of Thermos in writing, interalia, ()1) cancel or abandon the Mark, ()2) alter the Specification of goods, ()3) Consent to third parties using the Mark or closely resembling Trade Marks, ()4) assign the Mark or (5) save in the case of a breach of Clause 11 of the Agreement, cancel the entry of Thermos as a Registered User of the Mark. Further, Thermos as the Registered User of the Mark, has the right to institute proceedings for infringement in its own name without prior approval of Hodgson and has the right to enforce the said Agreement against assigns of Hodgson.
